Mahaka Kuu Masijala ya Moshi (Moshi Registry). Imeruhusu shughuli za kilimo kuendelea kwenye shamba la Kampuni ya Kilimanjaro Veggies inayomilikiwa na Mhe. FREEMAN MBOWE huku ikisubiriwa kusikilizwa kwa kesi ya msingi iliyofunguliwa dhidi Mkuu wa Wilaya ya Hai bwana Gelasius Byakanwa.
Katika kesi hiyo ambayo Kilimanjaro Veggies inadia fidia ya Million 549 kufuatia shamba lake kuingiliwa na kuharibiwa miundombinu yake na mshtakiwa huyo kampuni ya Kili Vegies inawakilishwa na Wakili Menraid D'souza.
Uamuzi wa kuruhusu shughuli za kilimo kwenye shamba ilo umetolewa na Jaji Sumari wa Mahakama Kuu Moshi. Maombi mengine yaliyomo kwenye kesi hiyo ni pamoja na kuondoa zuio lililowekwa na Mkuu wa Wilaya la kuzuia shughuli za kilimo kwenye shamba hilo. Uamuzi huo umetolewa leo tarehe 13. JULY 2017.
Kesi hii inafuatiwa baada ya kitendo cha Mkuu wa Wilaya hiyo cha tarehe 12 June 2017 cha kuvamia na kubomoa miundombinu na mazao ya shamba linalomilikiwa na kampuni hiyo lililopo kijiji cha Nshara ambapo ni nyumbani kwa Mbowe.
The High Court of Tanzania Moshi Registry has granted an interim order allowing Kili Vegies Limited a company owned by Hon. Freeman Aikaeli Mbowe to resume it agriculture activites on its farms which was earlier stoped by the orders of Hai Distirci Commissioner Mr Gelasius Byakanwa. In a rulling divered by Honorable Sumari, Judge of the Moshi Registry High Court following an application filed by the company through the services of Mr Menraid D'souza Advocate in the matter which the District Commissioner is sued in his personal capacity. Kilimanjaro Veggies is claiming some of Tshs. 549 Million against the DC who, according to the claims of the company, the DC had trespassed and destroy the green house infrastructure of the farm owened by the company without any legal or administrative justifications.
The case is following the act of the Hai DC who on the 12 June 2017 entered into the Companies farm in Mbowe's home Nshara Village where he ordered a total destruction of the green house farm claiming the same to be polluting a nearby river water.
